Terms and Conditions

  1. Preamble

www.meune.co (hereinafter referred to as the "Site") is published by the company MEUNE EI, whose head office is located at 19 Cité Nollez, 75018 Paris, and registered with the Trade and Companies Register of Paris under number RCS 823 708 037, whose intra-community VAT number is FR41823708037.

These general terms and conditions of sale (hereinafter referred to as "GTC") apply to any purchase of products offered for sale on the Site (hereinafter the "Items") selected by any consumer buyer for his own needs (hereinafter the "Customer") via the Site's electronic ordering service (hereinafter the "Order") from the company MEUNE EI (hereinafter referred to as "MEUNE"). They are permanently accessible on the Site.

MEUNE reserves the right to adapt or modify these GTC at any time. The version of the GTC applicable to any transaction being that appearing online on the Site at the time of the Order. Any Order implies the acceptance of the GTC without reservation. Acceptance of these GTC is materialized by a click of acceptance provided for this purpose before any validation of the Order, the terms of which are specified below.

The GTC constitute the entirety of the contractual relations between the parties and prevail over any other document exchanged between the parties, whatever the date of transmission to MEUNE. Any specific condition derogatory or additional to the GTC must be the subject of prior written acceptance by MEUNE.

Each of the new tools or features that are added to this shop is also subject to the Terms of Use. You can consult the most recent version of the Terms of Use at any time on this page. We reserve the right to update, modify or replace any part of these Terms of Use by posting said updates and/or modifications to our website. It is your responsibility to check this page from time to time to see if any changes have been made. By continuing to access the website or use it after the publication of modifications, you accept them. Our shop is hosted on Shopify Inc. This company provides us with the online e-commerce platform that allows us to sell you our products and services.


  1. Scope

The sale of Items on the Site is exclusively reserved for sales to individuals.

Under no circumstances may the Site be used by professional sellers, alone or in groups, regardless of the mode of marketing their products (marketplaces on the Internet, commercial galleries, intermediaries, physical stores, etc.). Professional sellers must contact MEUNE's commercial department directly.

The Customer acknowledges and accepts accordingly that the Items can only be purchased in quantities corresponding to the average needs of a consumer, both with regard to the number of Items ordered in a single order and the number of individual Orders respecting the usual quantity of an average consumer passed for the same product. MEUNE reserves the right to refuse an order that has obviously been validated by a professional seller customer.

MEUNE reserves the right to close any customer account and consequently refuse any sale to a customer in the following cases:

  • Default of payment of one or more previous orders,

  • Non-compliance with any of the Client's obligations defined in the GTC.

The Client will be informed by email of the closure of their customer account, the deactivation of their username and password.

Similarly, the Client may at any time inform MEUNE by email of their intention to close their customer account.

 

3. Availability of Items

The Items are offered for sale as long as they are visible on the Website. Offers are only valid while stocks last. In case of partial or total unavailability of an Item after an Order has been placed, the Client is informed by email as soon as possible of the unavailability of the Item and the partial or total cancellation of their Order.

MEUNE takes great care in presenting and describing its products to provide the Client with the best possible information. However, it is possible that non-substantial errors may appear on the Site.

 

4. Orders

The procedure for placing an Order on the Site is subject to the Client's compliance with the different steps they must follow to validate their Order.

The Client selects the Item(s), the size and quantity they wish to purchase on the Site by clicking on the "Add to cart" button.

When the Client wishes to validate their Order, they must click on the "Order" button accessible in the "Cart" tab.

The Client must then identify themselves. When registering, they must complete the form provided for this purpose under the "Registration" tab (including name, first name, email address, postal address, telephone number), this information being mandatory for the processing and delivery of Orders and the establishment of invoices. The Client must read and accept the privacy policy and personal data processing by checking the box provided for this purpose. If the Client is already registered, they will fill in their username and password to identify themselves.

The Client then chooses the corresponding option for the desired mode of delivery. The price corresponding to each mode of delivery is indicated.

Next, the Client has access to an Order summary containing, in particular, the price of the Items, the quantity requested, the unit cost of the Items, and the mode and cost of delivery. At any time, the Client can modify their Order and correct any errors.

The Client pays by choosing the means of payment and filling in the necessary fields.

After verifying the summary status of the Order and clicking on the "Pay my Order" button, the Client acknowledges having read and accepted the entirety of MEUNE's general terms and conditions of sale.

The Order is then registered and cannot be modified, without prejudice to the application of the article in these T&Cs relating to the right of withdrawal. Upon receipt of payment for the Order, MEUNE sends a confirmation email summarizing the Order (Items, price, quantity, etc.). The Order and invoice are available in the "My Account" section.

 

5. Prices and Payment Terms


Unless otherwise stated, the sale prices of the Items are indicated in euros (€) and include all taxes (including VAT, which may vary depending on the billing country).
These prices do not include shipping costs, which are invoiced separately. These costs are indicated before the Client places their Order and are listed separately in the Order summary. The total price of the Order (including all taxes and shipping costs) is indicated in the cart and at the time of the Order summary.

The different shipping methods are mentioned on the Site under the "Delivery" tab. The Client chooses the shipping method when placing their Order.

Regarding sales outside the European Union, the prices are understood to be FOB Paris. Customs clearance, payment of various duties or taxes are the responsibility of the Client.

MEUNE reserves the right to modify its prices at any time, but the Items will be invoiced based on the rates in effect at the time of the Order's registration, subject to availability.

Purchases are paid for via the secure platforms Shopify Payments/Paypal. The Client expressly acknowledges that the communication of their credit card number to MEUNE authorizes the debit of their account up to the amount of the Order.

The data recorded and stored by MEUNE constitute proof of the order and all past transactions. The data recorded by Shopify Payments/Paypal constitute proof of financial transactions.

6. Delivery

Delivery can only be made to countries listed in the "Frequently Asked Questions / Delivery" section.

The customer can choose from several delivery methods offered during the ordering process.

Delivery is made according to the delivery method chosen by the customer, as indicated in the order confirmation. The delivery times indicated on the site are indicative and correspond to the average processing and delivery times. MEUNE cannot be held responsible for the consequences of a delay in delivery that is not its fault. In addition, the day after the launch of a collection, the delivery time may be extended to 10 (ten) days, given the volume of orders.

Delivery is made to the delivery address indicated by the customer, it being specified that this must be the customer's place of residence, that of a person of his/her choice or of a legal entity (delivery to their company). Delivery cannot be made to hotels or post office boxes.

Orders are shipped on average within 24 (twenty-four) hours, but the delivery time may be extended up to 10 (ten) working days. To ensure that these deadlines are met, the customer must ensure that he/she has provided accurate and complete information regarding the delivery address (such as, in particular: street number, building number, staircase number, access codes, intercom names and/or numbers, etc.).

MEUNE will deliver the orders within a maximum delivery time of 14 (fourteen) working days for delivery to Metropolitan France and 20 (twenty) working days for international delivery from the day after the order is validated. In case of a delay in delivery, not justified by a case of force majeure, the customer may request the cancellation of the sale and obtain within a maximum period of 14 (fourteen) days following the date of denunciation of the contract a refund of the amounts paid on the occasion of the sale.

7. Right of withdrawal

The customer has a right of withdrawal for a period of 14 (fourteen) days from the receipt of his/her order.
The customer must notify MEUNE of his/her intention to withdraw by requesting a return on the site, in the "My Account / My Orders" section by clicking on "Return one or more products" or by sending the withdrawal form provided for this purpose when confirming the order, to the registered office of MEUNE. In the latter case, MEUNE will immediately send the customer an acknowledgment of receipt of the withdrawal by email.

The customer must return the Items to MEUNE within 14 (fourteen) days following the communication of their decision to withdraw. The Item(s) must be returned in their original packaging, in their original condition, new, unworn, and unwashed.

The customer bears the full cost of the return.

To make a return, the customer must follow the procedure indicated in the "FAQ / Return and Refund" section.

In the event of a return of the entire order, MEUNE will refund the full amount paid by the customer using the same payment method used to pay for the Order no later than 14 (fourteen) days following the date on which MEUNE became aware of the customer's decision to withdraw. MEUNE may defer the refund until the Items have been recovered or until the customer has provided proof of shipment of the Items, with the date of the first of these events being the one retained. The return costs are borne by MEUNE if the delivered Item is different from the ordered Item or damaged. In the event of non-compliance by the customer with these T&Cs, in particular the return conditions, MEUNE will not be able to proceed with the refund of the relevant Items.

For returns from countries outside the European Union: returns must be sent in Parcel (equivalent to Ordinary Parcel). The customer must fill out the CN23 customs declaration, indicating a description of the goods and ticking the "Return of Goods" box in the "Category of the shipment". The customer must also attach the invoice for the relevant Order to prove that it is the same merchandise.

 

8. Guarantees and Claims

Claims: Upon receipt of the Items, the Client must immediately check the condition and conformity of the Items with the Order, in particular the quality and quantity of the Items and their characteristics. If the Items are not in conformity with the Order or damaged, the Client must make reservations and claims with the carrier or refuse delivery if the package is open or damaged, and send its claims by registered letter to MEUNE - 19 Cité Nollez - 75018 Paris or by email at hello@meune.co within 14 (fourteen) days following delivery. The Client must then specify and justify in a comprehensive manner the reasons for the claim. No claim will be considered after use of the Items. No spontaneous return, without the agreement of MEUNE, will be accepted, except in the case of exercising the right of withdrawal.

Legal guarantee: The Items sold are also covered by the legal guarantee of conformity provided for in articles L. 217-4 to L. 217-13 of the Consumer Code and by the guarantee relating to defects in the thing sold, under the conditions provided for in articles 1641 to 1648 and 2232 of the Civil Code. In accordance with the provisions of article L. 217-15 of the Consumer Code, articles L. 217-4, L. 217-5 and L. 217-12 of the Consumer Code as well as article 1641 and the first paragraph of Article 1648 of the Civil Code are fully reproduced below.

Article L. 217-4 of the Consumer Code:

"The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery.

He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions, or the installation if the latter was made his responsibility by the contract or was carried out under his responsibility."

Article L. 217-5 of the Consumer Code:

"The goods comply with the contract:

1° If it is suitable for the use usually expected of a similar good and, if applicable:

  • if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

  • if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter."

Article L. 217-12 of the Consumer Code:

"The action resulting from lack of conformity is limited to two years from the delivery of the goods."

Article 1641 of the Civil Code:

"The seller is bound by the warranty for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have given a lesser price for it, had he known of them."

Article 1648 paragraph 1 of the Civil Code:

"The action resulting from redhibitory defects must be brought by the purchaser within a period of two years from the discovery of the defect."

Except as provided in these Terms and Conditions, sold Items are neither returnable nor exchangeable.

When acting under the legal guarantee of conformity, the consumer:

  • Benefits from a 2 (two) year period starting from the delivery of the goods to take action;

  • Can choose between repair or replacement of the goods, subject to cost conditions provided for in Article L. 217-9 of the Consumer Code;

  • Is exempted from providing proof of the existence of the lack of conformity of the goods during the 24 (twenty-four) months following the delivery of the goods. The legal guarantee of conformity applies independently of any commercial warranty provided. The consumer may decide to implement the warranty against hidden defects in the sold item as defined in Article 1641 of the Civil Code. In this case, the consumer may choose between canceling the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.


9. Responsibility

MEUNE only has an obligation of means for all stages of access to the Site, from the Order process to the shipment of the package or any subsequent services. MEUNE's responsibility cannot be engaged for any inconveniences or damages inherent in the use of the internet network, including a service interruption, external intrusion, or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and jurisprudence.

10. Personal Data

When registering the Customer's personal data, the latter must ensure the accuracy and completeness of the data provided. In the event of an error in the recipient's contact details, MEUNE cannot be held responsible for the inability to deliver the Order.

MEUNE collects personal data concerning the Customer during their registration for the purposes of any Order placed on the Site. This data is only used within the framework of MEUNE's commercial relationship with its Customer, in accordance with the privacy and personal data processing policy, which also specifies the rights that the Customer has concerning their personal data collected and processed by MEUNE.

11. Retention of Ownership

The ordered items remain the property of MEUNE until the full payment of the price by the Customer, in principal and interest. In the event of a payment incident on the agreed due date, MEUNE reserves the right to implement all necessary measures to recover the items.

12. Force majeure

In the event of the occurrence of a force majeure event, the concerned party must inform the other within a period of 14 (fourteen) days from the occurrence of this event, by registered letter with acknowledgment of receipt. All obligations of the parties will be suspended for the entire duration of the force majeure event, without compensation. If the force majeure event lasts for more than 3 (three) months, the relevant Order may be terminated automatically without compensation for either party.

13. Applicable Law - Mediation - Competent Jurisdiction
These CGV are subject to French law.

In the event of a dispute arising from an Order subject to these CGV, the Customer must address their complaints in writing to MEUNE by email at hello@meune.co or by post to the MEUNE headquarters, specifying and justifying in detail and in writing the reasons for the complaint.

If the dispute is not resolved after such a complaint, the Customer has the option of resorting to an alternative dispute resolution method.

The Customer has the right to use a consumer mediator, free of charge (excluding any legal or expert fees), in order to resolve any disputes with MEUNE amicably, provided that (i) the Customer has first attempted to resolve the dispute directly with MEUNE through a written claim as indicated above, (ii) their request is not unfounded, and (iii) the dispute has not already been examined by another mediator or a court. The Customer has a period of 1 (one) year from their written claim to MEUNE to make their request to the mediator.

Any dispute related to an order or the application or interpretation of these terms and conditions is subject to the exclusive jurisdiction of the competent courts of Marseille, regardless of the places of delivery of the items.
